Reatile Mosoeu Studios - Terms and Conditions of Sale (Digital Products)

Please read these Terms and Conditions carefully before purchasing digital products from Reatile Mosoeu Studios. By purchasing and downloading any digital product from our website, you agree to be bound by these terms and conditions. If you do not agree to these terms, do not purchase or download our digital products.

1. Agreement

These Terms and Conditions constitute a legally binding agreement between you (the “Customer”) and Reatile Mosoeu Studios, located at 20, 4th Avenue, Lambton, Germiston, South Africa.

2. Products and Services

Reatile Mosoeu Studios sells digital products available for download upon purchase. These products may include, but are not limited to: e-books, templates, software, graphics, music, courses, etc.]

3. Ordering and Payment

Order Placement: To purchase a digital product, you must follow the online ordering process on our website.

Payment: Payment is required in full at the time of purchase. We accept credit EFT (Paystack/PayFast) and PayPal transactions.

Pricing: All prices are listed on our website and are subject to change without notice. We are not responsible for typographical errors.

Order Confirmation: Upon successful payment, you will receive an order confirmation email containing details of your purchase and instructions for downloading your digital product.

4. Delivery and Download

Download Access: Upon confirmation of payment, you will be provided with a link to download your digital product. This link may be included in your order confirmation email or made available on a dedicated "Downloads" page within your account (if applicable).

Download Period: You are typically granted a limited time to download your purchased product (e.g., 7 days). After this period, you may need to contact us to reactivate your download link. We reserve the right to modify the download period at any time. It's your responsibility to download the purchased product within the granted period.

Technical Requirements: It is your responsibility to ensure that your computer system meets the minimum technical requirements necessary to download, access, and use the digital product. We are not responsible for issues arising from incompatible systems.

5. License and Usage Rights

Upon purchase, you are granted a non-exclusive, non-transferable license to use the digital product for personal use. This license does not grant you ownership of the intellectual property in the digital product. You may not:

• Resell, redistribute, or sublicense the digital product.

• Modify, adapt, or create derivative works from the digital product unless expressly permitted in writing by Reatile Mosoeu Studios.

• Share the digital product with others.

• Use the digital product in a way that infringes upon the intellectual property rights of others.

• Remove or alter any copyright notices or proprietary markings on the digital product.

• Use the digital product for any illegal or unauthorised purpose.

6. Intellectual Property

All intellectual property rights in and to the digital products, including but not limited to copyrights, trademarks, and trade secrets, are owned by Reatile Mosoeu Studios or its licensors. Your purchase does not transfer any ownership rights to you.

7. Refunds and Returns

Due to the nature of digital products, we generally do not offer refunds or returns once the digital product has been downloaded. However, we will consider refund requests in the following circumstances:

Defective Product: If the digital product is defective and prevents you from using it as intended, please contact us within 7 days of purchase with a detailed description of the issue. We will attempt to resolve the issue or provide a replacement. If we are unable to resolve the issue, we may offer a refund at our sole discretion.

Duplicate Purchase: If you have inadvertently purchased the same digital product twice, please contact us within 10 days of the second purchase, and we will refund the duplicate purchase.

All refund requests are evaluated on a case-by-case basis. Approved refunds will be processed within 20 business days.

8. Disclaimer of Warranties

The digital products are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Reatile Mosoeu Studios does not warrant that the digital products will meet your requirements or that the operation of the digital products will be uninterrupted or error-free.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Reatile Mosoeu Studios shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your purchase or use of the digital products, even if Reatile Mosoeu Studios has been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms and Conditions or the digital products shall not exceed the amount you paid for the digital product.

10. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms and Conditions shall be resolved through good faith negotiation. If the parties are unable to resolve the dispute through negotiation, either party may bring an action in the courts of the Republic of South Africa, Gauteng Province.

11. Amendments

Reatile Mosoeu Studios reserves the right to amend these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. It is your responsibility to review these Terms and Conditions periodically for any updates. Your continued use of our website and purchase of digital products after any changes constitutes acceptance of the revised Terms and Conditions.

We respect your privacy. We do not use any tracking technologies on our website. We do not display any advertisements. We collect only the necessary information to process your order and provide you with the digital product you purchased. Your payment information is processed securely by our payment processor PayPal, PayStack, PayFast]. We will not share your personal information with third parties except as required by law.
